These Terms & Conditions may change without prior notice.

1.Terms of the Contract

These Terms & Conditions apply to all goods supplied by Rugaura; they do not affect your statutory rights which are under the jurisdiction of Scottish Law.

Any order placed by you for goods on this website is considered an offer by you to purchase the goods.  No contract exists between you and us until we have received and accepted your order. We reserve the right to terminate the contract of sale if the payment for ordered goods is not received in full. Each time you place an order, you will receive an email confirming this. The notification of receipt is not a confirmation that the order has been accepted. We will exercise our statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms. 

Within the UK 50% deposit is required on order of bespoke commission work and the remaining 50% is due on delivery. For bespoke commissions ordered and to be delivered beyond the UK 50% deposit is required on order and the remaining 50% is due on completion and the customers satisfaction with images of the completed work.

The contract is subject to your right of cancellation.

2.Description and Price of Goods

All dimensions of items for sale on this website are approximate and every care has been taken to ensure that the colours are reproduced as accurately as possible. Care has been taken to describe and show all items as accurately as possible. If there is anything you wish to clarify prior to placing your order please contact us using the details on our Contact Us page.

Prices are supplied on the website in GBP 

If the goods are to be shipped to an address outside the UK, you will be liable to pay the appropriate duty on the goods as decided by the destination country. Rugaura is not liable for these duties.

3.Payment Processing

Payment through this website uses Paypal which is a safe, simple way to send and receive money online and you don’t need to have a Paypal account to use the service. Paypal uses the very latest SSL (Secure Socket Layer) encryption technology to ensure that you are safe while shopping online and at no time will Rugaura see your credit/debit card details.

You may also order by phone – you can call on 07964788501. We accept payment by credit card, debit card. If we are busy please leave a name and number and we will return your call. We do not store credit card details nor do we share customer details with any 3rd parties.

UK customers may also pay by cheque – please phone or e-mail your order in to us and then send your cheque made payable to Rugaura to Rugaura, The White Cottage, Kirkchrist, Kirkcudbright, DG6 4SB.  No goods will be dispatched until the order has been paid for in full and funds have cleared.

If your payment fails, your order will be cancelled within 14 days, unless you contact us to specify otherwise.

Our acceptance of your order brings into existence a legally binding contract between us. We will not be held responsible for pricing errors due to software mal-functions or human error.

4.Limitation of Liability

Rugaura will not be liable to you for any indirect or consequential loss or damage, or expenses arising from your purchase of goods from Rugaura and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for any goods purchased.

5.Data Protection

Rugaura will take all reasonable precautions to keep the details of your order and payment secure. However, unless Rugaura is negligent, we will not be liable for unauthorised access to information supplied by you. Rugaura will not supply your details to any third party.

6.Governing Law and Jurisdiction

These terms of sale and the supply of the goods will be subject to Scottish law and the Scottish courts will have jurisdiction in respect of any dispute arising from the contract.

7.Protecting Your Security and Your Right to Confidentiality

All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.  Any personal and sensitive information disclosed during the design collaboration will remain confidential and treated with respect. 

8.Placing an Order

By placing an order with Rugaura, you are confirming you have read and agree to the terms, conditions and delivery times as laid out in writing on this site.  The contract of the sale is bound by the terms laid out in this document.

The contract laid out in this document is between Rugaura and yourself, the customer.  In the event of goods shipped to an addressee other than yourself (the customer), we have no contract between ourselves and the end receiver of the goods shipped (your customer). In this case we cannot mediate any aspect of the sale between yourself (the customer) and the end receiver of the goods shipped (your customer).

9.Misuse of Goods

We make every reasonable effort to ensure that the information on this website is accurate and up-to-date. The material here is intended to provide general information and users are advised to seek further legal guidance before acting or relying on the contents. We disclaim all liability for loss and/or damage that may result from the use of information contained on this site.

Rugaura will not be held responsible for any death or personal injuries that occur from the misuse of goods advertised on this website.

All contents and information on this website, including without limitation text, graphic and images, is the property of Rugaura or the property of their respective owners and is protected by United Kingdom copyright laws. Images, logos, descriptions or text from our site must not be reproduced without written permission.

11.Trademarks

The Rugaura logo referenced on this website is the registered trademark of Ruguara in the UK and Europe.

Deliveries & Returns

1.Items Out Of Stock

Your order will usually be dispatched within 7 working days of payment. Occasionally if a product is out of stock it can take up to 28 days and we’ll inform you immediately by e-mail if there is such a delay via the billing email provided at checkout. Items out of stock can still be fulfilled but the lead time may be considerably longer than for those in stock. We will inform you of the estimated lead time when we contact you. It is the responsibility of the customer to respond to our out of stock email notification.

2.Deliveries

We will provide a dispatch date for items held in stock shortly after confirmation of your order. The dispatch date will be no more than 14 days following confirmation of your order. 

For deliveries within the UK, Fedex, DHL or Parcelforceare typically used. These services are economically priced and do not offer a flexible or guaranteed delivery day/time. Please ensure you provide a delivery address where someone will be available to receive the delivery between 7.30am and 6.00pm, Monday to Friday. If the couriers are unable to complete a delivery due to nobody being present, a calling card will be left asking you to contact them directly to arrange a re-delivery. If you do not contact the couriers within 2 days of receiving this card, the goods will be returned to our warehouse and a re-delivery charge may be applicable to your order. For oversized items or where flexibility of delivery day/time is required, we can offer alternative, chargeable services.

We will not be held liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this event, we will inform you of any delays as soon as possible. Delivery will be made to the Delivery Address specified at checkout when you complete your order or separately agreed by email. Should you wish to change the delivery address after goods have been dispatched from our warehouse, we will require you to cover the redirection charges. Please be aware that the redirection approval is subject to your order and account status. Rugaura retains ownership of all items until they have been paid for in full and delivered to the destination address. Once your goods have been delivered, the risk of damage or loss of the item passes to the recipient.

Please note that there may be extended delays over seasonal periods.

3.Returns

We hope you are delighted with your purchase from Rugaura. However, if you’re not happy for any reason please contact us to let us know that you wish to cancel your order, or return or exchange a product by emailing laura@rugaura.com or phone 07964788501.  

UK Returns

Return the goods to the address specified on the despatch note. Please include your contact information and a brief note explaining the reason for Return / Exchange in the package. For your protection we strongly recommend that you use a recorded-delivery service as all goods remain the responsibility of the customer until they are received by Rugaura. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty. Please inform us of your wish to return your purchase within 14 days of receipt. 

Goods must be returned to us in the original packaging or replacement packaging deemed suitable to protect the goods whilst in transit and they must arrive with us in the same condition as when sold. Once the goods have been received by us and we have confirmed their original condition, we will issue a refund for the amount paid (including delivery) minus the return charge.

Rest of the World Returns

For returns outside of the UK the customer is responsible for arranging the return and its cost.  Please contact us by email to confirm the return address. You must mark on the package that it is a return/replacement if it is a return from outside the United Kingdom, so that products do not attract possible customs duties and taxes on re-entering the UK. Please contact us for further details before sending the goods back. Please ensure the goods are securely wrapped in their original packaging or replacement packaging ensuring suitability to protect the goods in transit.  Once we receive the goods and their original condition is confirmed we will issue a refund.

Please contact us should you require replacement packaging.

Please note that a photograph of the packed item(s) will be required prior to return.

Custom/Bespoke products are non-returnable.

4.Item(s) Damaged on Arrival

 Occasionally, unfortunately, goods do get lost or damaged in transit. If this happens, please advise us within 48 hours and we will supply replacement goods as soon as possible. If you do receive damaged goods, please sign for the goods as “damaged”, retain all relevant documentation and provide photographic evidence of the damage to the item and the packaging so that an insurance claim can be made against the carrier’s insurers. We will arrange a courier collection of the damaged item. Once we receive the item, we will examine the goods for damage as per the photographic evidence you provide. If the damage is verified, we will replace the item at no additional cost to you. Please contact Rugaura to arrange a replacement timeframe.

5.Non-Delivery of Item(s)

Please allow 10 working days from dispatch for the delivery of ordered items. If the items are still not delivered after this time, please let us know (using the details on our contact us page). Please provide us with the original order number as reference. We will then investigate the non-delivery with the relevant delivery service provider used for the order and offer you a replacement order to be sent out or a full refund for the undelivered goods.

6.Refunds

If you are eligible for a refund, we will refund you via the method of payment you used when you originally paid for your order. The refund amount will be the total amount you have paid for the particular order or a fraction of this, depending on the nature of the fault at hand. Please note: it is your responsibility to advise us of any changes to your payment method.
